Can Spouses Use VA Loans? Key Rules Explained

When you or your partner has served in the military, the VA loan benefit is one of the most powerful tools for homeownership. It offers competitive interest rates, no private mortgage insurance, and often requires no down payment. But a common question arises when a non-service member marries a veteran: can spouses use VA loans? The short answer is yes, but the rules depend on whether you are buying a home together, taking over an existing loan, or navigating the loss of a service member. Understanding these nuances helps you avoid eligibility mistakes and fully leverage a benefit earned through service. This guide breaks down the scenarios, requirements, and steps so you can move forward with confidence, whether you are a spouse seeking to use your partner’s entitlement or a veteran wondering if your spouse can apply independently.

Because the VA loan program is designed for service members, veterans, and certain surviving spouses, the rules are specific. A spouse who is not in the military cannot apply for a VA loan on their own unless they meet surviving spouse criteria. However, when a veteran and spouse buy a home jointly, the spouse can be co-borrower on a VA loan. This distinction matters because it affects your eligibility, funding fee, and occupancy requirements. Let us explore each pathway in detail.

VA Loan Eligibility for Spouses: The Core Rules

The Department of Veterans Affairs guarantees a portion of the loan, which reduces risk for lenders and allows them to offer favorable terms. Eligibility is tied to the service member’s entitlement, not the spouse’s status. Therefore, a non-military spouse cannot independently qualify for a VA loan based on marriage alone. The veteran must be the primary borrower on the loan application, and their entitlement backs the loan. If the veteran has remaining entitlement, the spouse can be added as a co-borrower, which can help with income and debt ratios.

For example, if a veteran has already used part of their entitlement on another home, the remaining entitlement might be too low for a new purchase without a down payment. In that case, the spouse’s income can help qualify, but the veteran’s entitlement still anchors the loan. Lenders also require that the veteran occupy the home as their primary residence within 60 days of closing. This occupancy rule applies to the veteran, not the spouse, but both must sign the occupancy certification if they are on the loan.

It is also important to note that a spouse who is not a veteran cannot use a VA loan after a divorce if the veteran keeps the entitlement. However, if the veteran transfers their entitlement to the spouse as part of a divorce settlement, the spouse may be able to assume the existing VA loan, but not obtain a new one. In practice, this is rare and requires lender approval. The most straightforward route is buying together while married.

Scenario 1: Married Couples Buying a Home Together

When a married couple includes one veteran and one non-veteran, the veteran must be the primary borrower on the VA loan. The spouse can be added as a co-borrower, which is beneficial if the spouse has a strong income, excellent credit, or assets that strengthen the application. This does not change the fact that the veteran’s entitlement is used, but it does allow the lender to consider both incomes when determining the loan amount you can afford.

Here is what you need to know when applying jointly:

• The veteran must have a valid Certificate of Eligibility (COE) that shows sufficient remaining entitlement.
• Both spouses must meet the lender’s credit and income requirements, though the veteran’s credit is often the primary factor.
• The home must be the veteran’s primary residence, but the spouse is expected to live there as well.
• The VA funding fee may be higher for subsequent uses, but it can be waived if the veteran has a service-connected disability.

If the veteran has a disability rating that qualifies for a funding fee exemption, the spouse benefits from that exemption as well. This can save thousands of dollars upfront. Additionally, because the VA loan allows for 100% financing, you can preserve your savings for moving costs, furniture, or an emergency fund. Many couples find that combining the veteran’s benefit with the spouse’s income opens the door to a larger, more comfortable home than they could afford with a conventional loan.

One common mistake is assuming the spouse’s income is ignored if the veteran qualifies alone. In reality, lenders will include both incomes if both are on the loan, which can increase your purchasing power. However, they also include both sets of debts, so a spouse with high student loan payments could reduce the amount you can borrow. Work with your lender to model different scenarios.

Scenario 2: Spouses Using a VA Loan After Death of the Veteran

Surviving spouses of veterans who died in the line of duty or as a result of a service-connected disability may be eligible for a VA loan on their own. This is a special benefit that recognizes the sacrifices of military families. To qualify, you must meet one of the following conditions:

• The service member died in the line of duty, or from a service-connected disability, and you have not remarried (or remarried after age 57, or on or after December 16, 2003).
• The service member was missing in action or a prisoner of war for at least 90 days.
• The service member was totally disabled at the time of death, even if the death was not service-connected, and you meet certain criteria.

If you qualify as a surviving spouse, you can obtain your own Certificate of Eligibility and use the VA loan benefit without a co-borrower. This is a powerful benefit because it allows you to buy a home with no down payment and no PMI, just like a veteran. You also retain your eligibility even if you remarry, as long as you meet the age or date criteria above.

For spouses who do not meet these criteria, the options are limited. You cannot use the veteran’s entitlement after their death unless the loan is assumed or the property is transferred as part of an inheritance. In that case, you might take over the existing VA loan, but you cannot obtain a new one. This is why it is critical to understand your status before you begin house hunting.

If you are a surviving spouse, gather the veteran’s DD Form 214 and, if applicable, the death certificate and disability ratings. Submit these to the VA to request your COE. Many lenders can pull your COE electronically, but having the paperwork ready speeds the process.

Scenario 3: Assumption of a VA Loan by a Spouse

VA loans are assumable, meaning that a qualified buyer can take over the existing loan terms, including the interest rate and remaining balance. This can be highly advantageous if the original loan has a low rate. A spouse can assume a VA loan after a divorce or death, provided they meet the lender’s credit and income requirements and the lender approves the assumption.

If a veteran and spouse divorce, the spouse may be awarded the home in the settlement. The spouse can then apply to assume the VA loan, but they must demonstrate the ability to make payments. The veteran’s entitlement remains tied to the loan until it is paid off or the veteran requests a substitution of entitlement. This means the veteran may not be able to use their VA benefit for another home until the loan is assumed by a third party or sold.

In the case of death, a surviving spouse can assume the loan without needing to qualify if they are the legal heir. However, if the spouse later wants to sell the home or refinance, they may need to qualify for a new loan, which could be a conventional or FHA loan if they do not have VA eligibility. This is an area where professional guidance is essential, because the rules are nuanced and the financial stakes are high.

Key Requirements for Spouses to Qualify

Even when a veteran is the primary borrower, the spouse must meet certain criteria to be on the loan. Lenders evaluate both borrowers using the VA’s residual income guidelines and debt-to-income ratios. Here are the key requirements:

• Credit score: Most lenders require a minimum credit score of 620 for VA loans, though some allow lower scores with compensating factors.
• Stable income: The spouse must have a verifiable employment history, typically two years, and sufficient income to cover the mortgage and other debts.
• Debt-to-income ratio: The combined debt-to-income ratio should generally be 41% or lower, though exceptions exist with strong residual income.
• Occupancy: The veteran must certify that they intend to occupy the home as their primary residence. The spouse is expected to live there as well, even if not legally required.

If the spouse has poor credit, it could drag down the application. However, you might choose to apply with only the veteran on the loan to avoid this. In that case, the spouse’s name would not be on the mortgage, but they could still be on the deed, which gives them ownership rights. This is a common strategy for couples where one partner has credit challenges.

Another consideration is the funding fee. This is a one-time fee that ranges from 1.4% to 3.6% of the loan amount, depending on down payment and first-time or subsequent use. Spouses who are also veterans (e.g., both are service members) may have different fee structures. Always ask your lender to calculate the exact fee so you can budget accurately.

How to Apply for a VA Loan as a Couple

Applying for a VA loan with your spouse is straightforward, but you need the right documents. Start by obtaining the veteran’s Certificate of Eligibility. You can get this through the VA’s eBenefits portal, by mail, or through your lender. Many lenders can access your COE instantly if you provide the veteran’s DD Form 214 or other proof of service.

Next, choose a lender that specializes in VA loans. Not all lenders are equally experienced with VA underwriting, so look for one with a strong track record. During the application process, the lender will order an appraisal, which is required for all VA loans. The appraisal protects you from overpaying and ensures the home meets VA minimum property requirements. If you are buying a fixer-upper, you may need to use a VA renovation loan, which is a different product.

Your lender will also provide a Loan Estimate, which outlines the terms, monthly payment, and closing costs. Review this carefully. VA loans have strict rules about what you can be charged, and the lender cannot charge excessive fees. If you are comparing offers, use a mortgage calculator to estimate your monthly payment and total interest. MortgageZone offers a comprehensive mortgage calculator that can help you model different loan amounts, interest rates, and terms. This is a valuable tool when you and your spouse are deciding how much to borrow.

Once you submit your application, the underwriting process typically takes 30 to 45 days. The lender will verify income, assets, and credit, and the appraisal must come in at or above the purchase price. If everything checks out, you will move to closing, where you will sign the final paperwork and take ownership of your home.

Spouses Who Are Also Veterans: Dual Entitlement

When both spouses are veterans, you have additional flexibility. Each of you may have your own VA entitlement, which you can use together to buy a home. This is known as dual entitlement. You can combine your entitlements to purchase a more expensive home without a down payment, up to the county loan limit.

For example, if one veteran has full entitlement and the other has partial entitlement, the combined amount could cover a home price above the standard limit. This is a strategy used by many military couples. However, you must both meet the occupancy requirement, meaning both of you must intend to live in the home. If one of you is on active duty and stationed elsewhere, that could complicate matters, but you can still qualify if the other spouse will occupy the home.

If you are both veterans but one has a service-connected disability, you may be eligible for a funding fee exemption, which reduces your closing costs. Additionally, if you have used a VA loan before, your entitlement might be partially restored if you sold the previous home and paid off the loan. You can request a restoration of entitlement to maximize your benefit.

Common Mistakes to Avoid

Many couples make avoidable errors when using VA loans. Here are the most common pitfalls:

• Assuming the spouse’s income is not considered: As mentioned, lenders can include both incomes if both are on the loan, which can increase your buying power.
• Overlooking the funding fee exemption: If the veteran has a disability rating, you may not have to pay the funding fee. Always ask your lender about this.
• Not checking remaining entitlement: If the veteran has used a VA loan before, the remaining entitlement may be too low for a no-down-payment purchase. Check your COE early.
• Ignoring the occupancy rule: The veteran must move into the home within 60 days of closing. If they are deployed, you can request a delayed occupancy, but you need approval in advance.

Another mistake is not shopping around for lenders. VA loan terms can vary, and even a small difference in interest rate can cost you thousands over the life of the loan. Use a lender comparison tool to see offers from multiple institutions. MortgageZone connects you with lenders who understand VA loans, helping you find competitive rates and favorable terms.

Finally, do not forget about the VA’s minimum property requirements. The home must be structurally sound, safe, and sanitary. If the home fails the appraisal, you may need to negotiate repairs with the seller or walk away. This is why it is wise to include a VA escape clause in your purchase agreement, which allows you to back out if the appraisal comes in low or the home does not meet VA standards.

Refinancing Options for Couples

If you already have a VA loan and want to lower your rate or tap into your home’s equity, you have two main options: the VA Interest Rate Reduction Refinance Loan (IRRRL) and the VA cash-out refinance. Both require that the veteran is on the loan, but the spouse can be on the loan as well.

The IRRRL is a streamlined refinance that requires no appraisal and minimal paperwork. Its purpose is to lower your interest rate, and you cannot take cash out. This is a great option if rates have dropped since you bought your home. The cash-out refinance allows you to borrow against your home’s equity, but it may require a new appraisal and underwriting. If you are using the cash for home improvements or debt consolidation, this can be a smart move.

For spouses who are not veterans, you cannot refinance a VA loan into your own name unless you are a surviving spouse who qualifies. This is a common frustration after divorce, but it underscores the importance of planning. If you anticipate a divorce, consider refinancing into a conventional loan as part of the settlement, even if it means a slightly higher rate, to establish independent ownership.

Frequently Asked Questions About Spouses and VA Loans

Can a non-veteran spouse get a VA loan if the veteran does not occupy the home? No. The veteran must occupy the home as their primary residence. There are no exceptions for investment properties or homes for the spouse only.

Can a spouse use a VA loan after the veteran has passed away? Yes, but only if you are a surviving spouse who meets the VA’s criteria. You must not have remarried (or remarried after the allowed age/date), and the veteran’s death must be service-connected or meet other conditions.

Does the spouse’s credit score matter? If the spouse is on the loan, yes. If not, the spouse’s credit is not considered. However, if the spouse has a history of late payments, it might not affect the application if they are not a borrower.

Can a spouse assume a VA loan after a divorce? Yes, with lender approval. You must meet credit and income requirements, and the lender must agree to the assumption. The veteran’s entitlement remains tied to the loan unless a substitution is requested.

What if the veteran has used all their entitlement? If the veteran has no remaining entitlement, they cannot get a new VA loan. You would need to pay off the previous loan or sell the property to restore the entitlement. A spouse cannot provide entitlement.

These are the most common questions, but your situation may be unique. Speaking with a VA-approved lender is the best way to get personalized answers. They can review your eligibility, explain your options, and guide you through the process.

Final Thoughts on Spouses and VA Loans

Understanding whether spouses can use VA loans is essential for military families planning their financial future. The key takeaway is that a non-veteran spouse cannot independently use the benefit, but they can be a powerful co-borrower with their veteran partner. Surviving spouses have separate eligibility, and assumptions are possible in specific cases. By knowing your status, gathering the right documents, and working with an experienced lender, you can unlock the full value of this earned benefit.

Before you start your home search, take the time to check your entitlement and get pre-approved. This will give you a clear picture of your budget and strengthen your offer when you find the right home. Use tools like MortgageZone’s mortgage calculator to estimate payments and compare scenarios. With the right preparation, you and your spouse can confidently navigate the path to homeownership.
